Both of these categories of the check, relating to Right to Work legislation, arose post-covid for employers from updated Home Office guidance:
Identity Document Validation Technology (IDVT) is now being acknowledged by the Home Office as beneficial for businesses to conduct digital Right to Work checks. IDVT encompasses several new digital technologies - cloud, mobile, AI (artificial intelligence) and ML (machine learning) that are becoming common place as a means to digitise and automate those processes that traditionally undertaken manually.
Coincident with the Government’s removal of the ability for employers to conduct COVID-adjusted checks - the use of IDVT to conduct was legitimised in 2022. This enables candidates to submit and authenticate certain documents remotely (British and Irish Passports and Irish Passport Cards). This development is widely regarded as a major step forward in the digitisation of Right to Work checks.
The technology is provided by an Identity Service Provider (IDSP) - such as Rightcheck. The provider can acquire certification by meeting the requirements of a new UK Digital Identity and Attributes Trust Framework (UKDIATF).
For businesses, who for operational reasons, need to hire remotely they can conduct an IDVT check in effect a Right to Work check undertaken remotely but only via a certified solution, such as Rightcheck.
These Remote IDVT checks can be undertaken only in the case of individuals holding in-date British & Irish Passports (or Irish Passport Cards). Depending on your candidate immigration profiles, this could mean up to 90% of your candidates being checked remotely, without the need for your recruiter/hiring manager to undertake a face-to-face Right to Work check.
However, the employer retains responsibility for ensuring the IDSP they elect to utilise is conducting checks according to legislation.

Because of the remote/virtual nature of IDVT checks, an ‘imposter check’ is required for employers/recruiters to address compliance and acquire a ‘Statutory Excuse’. This involves ensuring the person presenting themselves for work, is the individual who has been checked remotely and not an imposter.
However, once again the challenge for employers is to ensure they have a robust process in place to ensure Imposter Checks are consistently undertaken and recorded. Many employers have either overlooked this requirement, or found it difficult to incorporate it into their workflow. Employers must have a mechanism to know who has been checked via IDVT, if they need an Imposter check, or if one has already been conducted and recorded.
